The City of York enforces its property maintenance code the way most Pennsylvania third class cities do: a notice of violation with a compliance date, reinspection, then citations and fines that run per day. Owners of tenant occupied houses also sit under Article 1761 of the codified ordinances, the licensing and inspection program for rental units. Can you sell with open violations?

Yes. Code violations in Pennsylvania attach to the property, not the person, and nothing in the City of York’s code requires the violations to be cured before a deed can record. What changes is who owns the problem after closing. A retail buyer with a mortgage usually cannot close on a house with an active condemnation or unsafe structure notice, because the lender will not fund it. A cash buyer can, and the compliance date becomes ours.

The Article 1761 rental license

Every tenant occupied residential unit in the city needs a license, and the city inspects the unit before issuing or renewing it. The license and inspection fees are set by City Council resolution, not fixed in the ordinance. If your license lapsed, or you never had one because you inherited a rental and kept the tenant, you are not required to bring it current before selling to us. The license is issued to the owner, so a new owner applies fresh anyway. In 2025 the city was working through amendments to Article 1761 covering local owner representatives and stronger penalties; the direction is more enforcement, not less, which is one more reason to move a problem rental sooner.

What you still have to disclose

The Seller Disclosure Law applies. A known code violation, an open notice, or a condemnation is a material fact, and it goes on the statement (or, if you are selling as an estate fiduciary, gets disclosed even without the form). Tell us up front. It is priced in on day one, and it never becomes a reason to lower the number later.

How the numbers work on a violation house
